An encounter with the police often means one’s rights are on the line. Some law enforcement officers may overstep their boundaries to make an arrest or gather evidence. This is why it is important for Michigan citizens to know their rights concerning criminal law and where to turn for assistance if they feel their rights have been violated.
Recently, police followed a vehicle that had aroused their suspicion. The officer reported that the driver of the vehicle sped up and ran a stop sign, which gave police cause to pull him over. However, the driver allegedly accelerated, initiating a police chase that ended when the car struck a utility pole. Police say a subsequent search of the man revealed a pipe with the residue of methamphetamine in his pocket.
Police claim the man admitted he had been smoking marijuana and meth earlier in the day. He now faces charges that include possession of methamphetamine, operating a motor vehicle under the influence of drugs, fleeing and eluding, and driving without a license. He also had a felony warrant related to an assault charge from another incident.
Reports do not indicate whether Michigan police informed the man of his rights before the man allegedly confessed to having used drugs before driving. A skillful criminal law attorney will examine the circumstances of the arrest and search and the evidence police gathered. In these cases, it is wise to have legal advocacy. A violation of rights before or during an arrest can affect the admissibility of any evidence police collect.
