Michigan has a zero-tolerance policy for drunk driving, also referred to as operating while impaired or an OWI. All drunk driving convictions will have some form of license suspension or limitation and hefty fines.
Defending yourself or accepting a plea deal may be tempting, but without an experienced DUI defense attorney by your side, you may be missing key elements for your defense.
What To Do If You Are Stopped For Drunk Driving
Here in Michigan, if stopped for an OWI, you should expect the following:
- You will be asked to take a Breathalyzer. Refusing to take a Breathalyzer test is a violation of Michigan’s implied consent laws. Refusal leads to an automatic license suspension. You have 14 days to appeal a suspension that results from refusal.
- You may be asked to submit to a blood draw or urine sample. In this instance, it may take some time to hear back about your test results and how that may change your case. Similar to a Breathalyzer, you may refuse to test, but it likely will not help your case and, in many cases, refusal makes your situation worse.
None of these tests are ironclad. Errors in calculation or machine use may skew the results of a test. Our criminal defense lawyers know the science behind blood alcohol testing. We will use our knowledge to defend you and your rights.
States across the Midwest are increasingly strict about intoxicated driving. With all of the different state laws at play, some of our regional clients are subject to different laws. Contact our office for more information.
